Terms and Conditions for Online Sales

Welcome to Denby Koi Ponds. These terms and conditions apply to all online purchases made through our website. By placing an order, you agree to the following terms:
1. General Information
1.1. DKP Aquatics Ltd is a registered business in the UK, located at the Denby Pottery Village, DE5 8NX .
1.2. We sell Koi ponds, Koi fish, as well as pond and pet supplies online and in our physical store.
2. Orders & Payments
2.1. All orders are subject to availability. We reserve the right to cancel orders if stock is unavailable.
2.2. Prices are listed in GBP (£) and include VAT where applicable.
2.3. Payments must be made in full before dispatch. We accept payments through Stipe and Paypal.
3. Delivery & Collection
3.1. We offer delivery within the mainland of the UK. Estimated delivery times are provided at checkout but may vary.
3.2. Delivery charges apply and will be displayed at checkout.
3.2.1. General goods are dispatched next day delivery, orders over £50 receive free delivery.
3.2.2. Koi fish are dispatched by specialty courier overnight for a fixed fee of £29.95. Fee is per shipment, but multiple Koi might incur an additioanl charge, depending of the size of the fish.
3.2.3. Ponds are delivered within 60 miles for a fixed fee of £75. Destinations further than 60 miles are charged at £1.50 per mile.
3.3. Customers can also collect their orders in-store at our store during business hours.
4. Returns & Refunds
4.1. Customers have the right to return items within 14 days of receipt, as per UK consumer law.
4.2. Items must be returned unused, in original packaging, and with proof of purchase.
4.3. Refunds will be processed within 14 days of receiving the returned item.
4.4. Certain items (e.g., perishable goods, personalised items) may not be eligible for return.
5. Faulty or Damaged Goods
5.1. If an item arrives damaged or faulty, please contact us within 48 hours of delivery.
5.2. We may offer a replacement, repair, or refund depending on the circumstances.
6. Cancellations
6.1. Orders can be cancelled before dispatch for a full refund.
6.2. If an order has already been shipped, customers must return the item in accordance with our returns policy.
6.3. Pond orders cannot be cancelled after 14 days.
7. Privacy & Data Protection
7.1. We collect and process customer data in line with GDPR and our Privacy Policy.
7.2. Personal information is used only for order processing and customer service.
8. Liability
8.1. We are not liable for delays or failures due to events beyond our control.
8.2. Our total liability for any claim will not exceed the price paid for the product in question.
9. Governing Law
9.1. These terms are governed by the laws of England and Wales.
9.2. Any disputes will be subject to the jurisdiction of the courts of England and Wales.
